MyChart at Stanford Children’s Health

Before signing up for MyChart, it is important for you to understand all of the following:

1. MyChart provides only portions of the medical record.

2. MyChart is intended for communicating non-urgent matters.

3. For children under 12 years of age, parents can access portions of their child’s medical records through MyChart.

4. For children ages 12 to 17, state and federal law limits parental access to their child’s medical records. Parents or legally designated representatives of the patient must request proxy access to a minor’s MyChart account.

5. Responses to MyChart communication are not immediate and may take at least 2 business days.

6. Certain lab results are prohibited by law to distribute electronically. You need to request that result via HIMS (Medical Records) Department.

7. Stanford Children’s Health may terminate MyChart access without prior notice and without cause.

8. Stanford Children’s Health cannot guarantee absolute security against intrusions, disclosure, unauthorized access, and compromised integrity of the record within MyChart.

9. By signing up for access to MyChart, you assume all risks associated with the website (ex: viruses, defects, interceptions, etc.)

Terms and Conditions

Welcome to MyChart at Stanford Children’s Health website. Stanford Children’s Health (“STANFORD CHILDREN’S HEALTH”, “we” or “us”) is pleased to offer you information via a Web-based version of our computer charting system, called MyChart. We think it is important for you to know how we handle information we communicate via the Internet. The Terms and Conditions Statement outlines Stanford Children’s Health’s practices and our sensitivity to your right to privacy.

MyChart is not a complete copy of the patient’s medical record. It is a subset of some information which the patient might find helpful. Stanford Children’s Health reserves the right to limit or terminate your use of MyChart if you fail to abide by the Terms and Conditions. Please take the time to review them carefully.

MyChart should never be used for urgent matters. MyChart is not a substitute for direct care and should not be used for emergencies or urgent matters that could affect your health. For all urgent matters, please contact your physician’s office by telephone, go to an emergency room, or dial 9-1-1.

Response to Electronic Communication

Stanford Children’s Health will make its best efforts to provide timely responses to electronic inquiries. In some cases, Hospital staff responsible for replying to electronic communication may not be available, therefore patients or their legally designated representative (“LDR”) should allow at least two business days for a response.

If your provider is out of the office or unavailable, messages sent through MyChart may be routed to other authorized caregivers within the Stanford Children’s Health in order to facilitate a timely response to your request.

With respect to any electronic communication sent by the patient or LDR, Stanford Children’s Health is only able to respond to such communications based on the information provided by the patient or LDR. If there is insufficient information provided, Stanford Children’s Health will be unable to provide accurate, reliable services.

Acceptance of Terms and Conditions

When you access, use or view this website, you thereby agree to be bound by this agreement regarding the terms and conditions of use (“Terms and Conditions”). Please note that Stanford Children’s Health may revise these Terms and Conditions at any time by updating this posting. If you access, use or view this website after such revisions have been made, you may be forced to accept the revised Terms and Conditions and you will be bound by them; therefore, we advise you to periodically review this page for such revisions. User Responsibility

You agree that the MyChart service is offered as a convenience to you as an Stanford Children’s Health patient, that it permits you to access portions of your Stanford Children’s Health medical record, and that you are solely responsible for any MyChart information that you communicate, whether intentionally or not, to others. As Stanford Children’s Health employees other than your individual healthcare provider may be involved in handling your communications, you should not use MyChart for confidential information you wish to discuss only with your health care provider. You are responsible for any use of MyChart by your agents or dependents, and you agree to inform such agents or dependents of these Terms and Conditions and their obligations to comply with them. You may not assign the rights and obligations accruing to you under these Terms and Conditions without the prior written consent of Stanford Children's Health, and any attempted assignment not in compliance with this sentence shall be void.

Your Privacy

Stanford Children's Health considers your privacy to be of vital importance. Please review our Privacy Practices http://www.stanfordchildrens.org/en/patient-family-resources/privacy-policy which explains how we process your information and how your information may be used at Stanford Children's Health.

All communications containing confidential medical information that are transmitted and received through the MyChart site are subject to all state and federal laws guarding the security and confidentiality of medical records. Upon accessing MyChart, our web server collects and stores the following information: (1) the domain name from which you access the Internet; (2) the date and time you access the site; (3) the pages you visit; (4) the address of the website from which you linked directly to us; (5) the name and release number of the web browser software you are using; and (6) the IP (Internet Protocol) address of the computer you are using. This information may be used by Stanford Children's Health for internal evaluation, quality control, and other reasons deemed appropriate by Stanford Children's Health.

MyChart Enrollment

Your enrollment in MyChart is contingent on verification of your identity by a Stanford Children's Health representative in person, with photo identification. When you first enroll in MyChart, you will receive an access code from Stanford Children's Health. This access code will permit you to create a user identification (“User ID”) and password, which will be used to log into the site. If you fail to use your access code within sixty (60) days of receiving it, it will expire and you will have to obtain a new access code from Stanford Children's Health to enroll in MyChart. After you create your User ID and password, your access code will immediately expire and can no longer be used.

Passwords

The security of your personal health information contained in your MyChart is dependent upon selecting a secure password. It is your responsibility to create a secure password. At a minimum your password must be between eight and fourteen characters long, contain at least one letter and one number and cannot be the same as your User ID. Passwords should not contain words, your birthday, your social security number or any other easily guessed information.

It is extremely important that you keep your access code, User ID and password confidential, as anyone who knows them will have access to your confidential medical information and can send and receive electronic communications as if he or she were you. It is your responsibility to safeguard your User ID and password, and to notify Stanford Children's Health immediately and change your password if you believe the security of your information has been compromised. In addition, in order to maintain the security of the site, you may be forced to change your password at any time, without prior notice, upon login and before you are allowed access to your account. You can change your password by clicking the “Reset Password” link on the MyChart homepage. If it is discovered that you have inappropriately shared your password with another person, or otherwise misused or abused your privileges to access MyChart, Stanford Children's Health may discontinue your access to MyChart without prior notice.

Electronic Communications

Stanford Children's Health or its team may send you secure messages through MyChart which contain confidential medical information and other information important to the maintenance of your health. All communications using MyChart take place via a secure Internet connection. You will receive electronic mail (“e-mail”) notifying you that new information is available for you on MyChart, but these e-mails will not contain any confidential medical information. However, any person with access to your email account will be able to see this notification. This includes you, your spouse, employer or anyone else that can access your email account. Patients should take this into account when providing an email address.

You may also communicate information to MyChart through the secure Internet connection. When using MyChart to send secure messages to the health care team, use the provided drop down box relating to the subject of the communication in the message’s subject line. If your provider is not available, messages sent through MyChart may be forwarded to other authorized Stanford Children's Health providers.

MyChart is not intended to replace or to serve as a substitute for in-person meetings and/or personal conversations with your physician. If MyChart is unavailable, you should use other means to contact Stanford Children's Health and your health care team for non-urgent matters.

Please note that the contents of any MyChart communication may become part of your permanent health record. This communication does not constitute an addendum or amendment to your existing medical records and is not considered part of your designated medical record set. To exercise your legal rights in requesting an addendum or amendment of your medical records you should contact Stanford Children’s Health’s Health Information Management Services at 4700 Bohannon Dr, MC 5900 Stanford, CA 94025.

Test Results

By agreeing to these Terms and Conditions you provide Stanford Children's Health the right to post all test results to MyChart that are not expressly forbidden by law. Should you decide you no longer would like electronic transmission of your test results, you can choose to deactivate your account. Not all test results and other such information are posted to the MyChart site. Therefore, it is your sole responsibility to ensure that you request and verify results for all tests you have taken by contacting Stanford Children's Health directly.

The California Health and Safety Code section 123100-123149.5 states: …none of the following clinical laboratory test results and any other related results shall be conveyed by Internet posting or other electronic means:

1) HIV antibody test.

2) Presence of antigens indicating hepatitis infection.

3) Abusing the use of drugs.

4) Test results related to routinely processed tissues, including skin biopsies, Pap smear tests, products of conception, and bone marrow aspirations for morphological evaluation, if they reveal malignancy.

What happens when my child turns 12?

Currently, State of California regulations as well as the Health Insurance Portability and Accountability Act (HIPAA) limits parent/guardian access to records for individuals between the ages 12 and 17 years old. Within these limits, we do offer account access to both parents and patients 12 to 17 years of age in order to help adolescents begin to take responsibility for their own health.

Individuals may request proxy acces to a minor’s MyChart account during a clinic visit. Such access will be granted to parties with parental rights or legal guardianship over the patient and only to the extent that the party requesting can demonstrate the legal right to that patient’s medical information. If the proxy’s legal relationship with account holder changes, please notify the hospital. Stanford Children’s Health reserves the right to revoke proxy access at any time for any reason.

At the age of 18, your child can create his/her own Stanford Children's Health MyChart account and access his/her own records.

Security; Risks of Using Secure Sites and Secure Messaging

Stanford Children's Health uses 128-bit encryption technology and takes other precautions to ensure that the information contained or transmitted via MyChart is as secure as reasonably possible from unauthorized use or access. As such, your browser must be enabled to transmit via Secure Socket Layer (SSL) protocol and 128-bit encryption. If your browser currently does not support this protocol, you will see a prompt asking you to update your security and a link to a site where you may obtain the necessary plug-in at no charge. SSL is used for transmitting personal demographic information, personal health information and credit card information. Stanford Children's Health is using industry-standard encryption technologies to protect and secure the MyChart site, including the secure messaging function. Because of the added security of web-based, encrypted messaging, Stanford Children's Health strongly recommends the use of secure messaging via MyChart, instead of e-mail, for online communications.

However, please note that while Stanford Children's Health takes measures to safeguard your security, we cannot guarantee absolute security of the system against inadvertent disclosure or intentional intrusion. The use of electronic communication systems such as the World Wide Web (including secure messaging) for communications has a number of risks that users should consider before use. Such risks include, but are not limited to, the following:

  • Electronic communications can be copied, circulated, forwarded and stored, in numerous paper and electronic files. Electronic communications can be accidentally broadcast worldwide and received by many unintended recipients. Backup copies of electronic communications may exist even after the originator or recipient has deleted his or her own copy. Employers and online services have a right to archive and inspect e-mails transmitted through their systems.
  • Message senders can misaddress a message. Messages can be intercepted, altered, forwarded, or used without written permission or detection. E-mail notifications can be used to introduce viruses into computer systems. Electronic communications may not be answered in the time frame expected by the parties or they can be misinterpreted.
  • Electronic communications are discoverable and can be used as evidence in court.
  • Passwords providing access to electronic communications can be stolen and misused, or host systems can be compromised, leading to unauthorized disclosures of personal information.

As a result of these risks, Stanford Children's Health cannot guarantee the security and confidentiality of secure messaging and other communication submitted through MyChart, and will not be liable for improper disclosure of confidential information.

YOU HEREBY EXPRESSLY ASSUME THE FOLLOWING RISKS, INCLUDING BUT NOT LIMITED TO INTENTIONAL INTRUSION, UNAUTHORIZED DISCLOSURE, FAILURE, DELAY, INTERRUPTION OR CORRUPTION OF DATA OR OTHER INFORMATION TRANSMITTED IN CONNECTION WITH THE USE OF THIS SERVICE.

Accuracy and Integrity of Information

Stanford Children's Health attempts to ensure the integrity of the site, but makes no guarantees about the accuracy of the site. It is possible that the site would include typographical errors, inaccuracies, or other errors. Should you find any information to be inaccurate, please submit a written and signed request to Stanford Children's Health’s Health Information Management Services at 4700 Bohannon Drive, MC 5900 Menlo Park, CA 94025 explaining which information is inaccurate and how it should be corrected. Information contained on the Stanford Children's Health site may be changed or updated without notice. Submission of a signed request does not guarantee the information will be updated nor imply a timeframe for updates.

Website Availability

Although Stanford Children's Health works to communicate when MyChart will be unavailable due to maintenance, backup procedures, or other system outages, providing such advance notice may not be possible at all times, and Stanford Children's Health cannot guarantee that you will be able to access MyChart at any particular time. During times when MyChart is unavailable, other communication methods (such as the telephone) should be used to contact Stanford Children's Health.

License and Website Restrictions

Stanford Children's Health grants you a limited, revocable, nontransferable and nonexclusive license to access and make personal use of this website, the material provided hereon, and the accompanying services. You may not, however, in whole or in part use, reproduce, or copy the MyChart site or modify any content or any proprietary notices from materials downloaded or printed out from MyChart. Furthermore, this limited, revocable license does not include the right to: any use of the content of this site for the benefit of a third party or for personal financial benefit, except as MyChart contemplated by these Terms and Conditions; any derivative use of this website or its contents; any transmission or provision of any content from the MyChart site to a third party, except as specifically provided by these Terms and Conditions; any incorporation of data or other content from MyChart in a product designed, developed, marketed, sold or licensed by you or on your behalf; any use of data mining, robots, or similar data gathering and extraction tools; or any use of MyChart in a manner contrary to any applicable law. This website (or any portion thereof) and all of the content is the property of Stanford Children's Health, its licensees, or its content providers, protected by United States and international copyright and other laws, and cannot be reproduced, duplicated, copied, published, sold, visited, or otherwise exploited for any commercial purpose without express written consent from Stanford Children's Health. You may not use any Stanford Children's Health logo or other proprietary graphic or trademark as part of the link without express written permission from Stanford Children's Health. Any unauthorized use automatically terminates the licenses and permission granted above by Stanford Children's Health. In consideration for Stanford Children's Health’s permitting you to use MyChart you expressly release and hold harmless Stanford Children's Health, its trustees, officers, directors, employees, agents, and affiliates from any and all claims, liabilities, demands, causes of action, costs, expenses, and damages of every kind and nature, in law or equity, or otherwise, arising out of or in any way related to your use of MyChart, whether arising from negligence or any other acts or omissions by Stanford Children's Health.

In addition, you will indemnify and hold harmless Stanford Children's Health, its trustees, officers, directors, agents, affiliates, and employees, against all actual and direct losses, liabilities, damages, claims, costs or expenses (including reasonable attorney’s fees) they may suffer as the result of third party claims, demands, actions, investigations, settlements or judgments against them arising from or in connection with any breach of these Terms and Conditions, or from any breaches of confidentiality or negligence or wrongful acts or omissions, by you or your dependents, or agents.

The provisions of this section entitled “Limitations of Liability; Indemnity” shall survive termination of this agreement.

Applicable Laws; Arbitration; Venue

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to conflicts of law principles.

You agree that any dispute, controversy or claim arising out of or related to these Terms or your use of the Site will be solely and exclusively resolved and settled through arbitration administered by the American Arbitration Association and conducted in Santa Clara, California, United States of America. Judgment on any award rendered by the arbitrator may be entered in any court of competent jurisdiction. The prevailing party shall be entitled to costs and reasonable attorney’s fees arising out of such arbitration.

Representations of User

You hereby represent and warrant that (1) you are at least eighteen (18) years old, or have provided Stanford Children's Health with a court order indicating that you have obtained emancipated minor status, and that you possess the legal right and ability to enter into this agreement and to use the website in accordance with these terms and conditions; and (2) the information you submit to Stanford Children's Health to gain registration is accurate, true, current and complete.

It is unlawful to misrepresent yourself in an attempt to gain access to someone else’s personal health data and unauthorized activities may be subject to prosecution.

Your access to and use of the MyChart site are subject to all applicable federal, state, local and international laws and regulations. All patient information viewed through MyChart is strictly confidential and is subject to the protections of applicable state and federal law.

Account Deactivation

An account may be deemed abandoned and expired if the account has no activity for two calendar years. In order to maintain an active status on your account, then it is your responsibility to periodically login. Should your account be expired, you must contact Stanford Children's Health in order to receive a new activation code.

Termination of Access

Abuse of the MyChart privilege, excessive messaging, or repeated failure to show up for appointments that you have scheduled through MyChart may cause your MyChart access to be revoked without prior notice. Stanford Children's Health may terminate your access to MyChart at any time, without notice, and with or without cause.

Notice

Notices sent to you by Stanford Children's Health in connection with these Terms or your use of the Portal may be delivered to you by electronic mail, a general notice on the Portal, or by written communication delivered by first class U. S. mail. You must give notice to Stanford Children's Health at any time by letter delivered by first class postage prepaid U. S. mail or overnight courier to the following address:

These Terms are severable to the extent any term is deemed invalid, illegal or unenforceable.

Stanford Children's Health's failure to enforce any provision of these Terms shall not be deemed a waiver of that or any other provision of these Terms.

The parties to this agreement are independent contractors of one another; nothing herein shall be deemed to create any relationship of agency, partnership or joint venture between the parties.

You may not assign any of your rights and obligations arising under these Terms without the prior written consent of Stanford Children's Health; any attempted assignment not in compliance with this sentence shall be void.

You Agree that Stanford Children's Health May Use and Disclose Certain Information About You

You agree that, should you elect to supply it, Stanford Children's Health may use your name, email address, physical address, or other data to communicate with you. You may request to have this information modified or deleted from our records. Stanford Children's Health may use or share this information as necessary to enforce these Terms. You further agree that Stanford Children's Health may use the information for its internal business purposes and disclose the information to third parties who are performing services on its behalf. Stanford Children's Health will not otherwise share this information with any other party unless allowed or required by law.

Web Server Logs

When you access the Portal, the following information is collected and stored automatically by our web server and is used in an aggregate way to help improve our site:

  • the name of the domain from which you access the Internet
  • the date and time you access the Portal
  • the pages you visit
  • the Internet address of the web site from which you linked directly to us
  • the name and release number of the web browser software you are using
  • the Internet Protocol (IP) address of the computer you are using

General

These Terms and Conditions constitute the entire agreement between you and Stanford Children's Health and govern your use of the website. This agreement supersedes any prior agreements between you and Stanford Children's Health relating to the access and/or use of the MyChart site and associated services. No modification or attempted modification of these Terms by you shall be binding on Stanford Children's Health unless made in writing and physically signed by an authorized representative of Stanford Children's Health.

A waiver of any breach of any provision of these Terms and Conditions shall not be deemed to be a waiver of any repetition of such breach or in any manner affect any other terms or conditions of these Terms and Conditions. The failure of Stanford Children's Health to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision.

If any provision of the Terms and Conditions is found to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms and Conditions remain in full force and effect.

The use of this site is unauthorized in any jurisdiction that does not give effect to the Terms and Conditions contained herein.
